Central Consumer Protection Authority notifies online retailers who offer toys not adhere to BIS Standards

Amazon, Flipkart, and Snapdeal received notices from the Central Consumer Protection Authority (CCPA) for selling toys that did not adhere to the requirements that the Central Government has mandated as mandatory. The Consumer Protection Act of 2019’s provisions may be used to take required action against the e-commerce businesses if they fail to respond within seven days of the notice’s issue.

The CCPA has also sent a letter to the Director General of the Bureau of Indian Standards (BIS) requesting that he take urgent notice of the situation and take the appropriate measures.

Consumer durables like electric immersion water heaters, electric irons, domestic gas stoves, microwave ovens, and sewing machines are now included in the nationwide campaign launched by the CCPA to stop the sale of fake and counterfeit goods that violate Quality Control Orders (QCOs) issued by the Central Government.

Regarding the production or sale of such goods, the CCPA has written to District Collectors all over India requesting that they look into any unfair business practices and consumer rights violations and submit an action taken report to the CCPA.

Under Section 2(10) the Consumer Protection Act, 2019, “defect” means any fault, imperfection or shortcoming in the quality, quantity, potency, purity or standard which is required to be maintained by or under any law for the time being in force or under any contract, express or implied or as is claimed by the trader in any manner whatsoever in relation to any goods or product and the expression “defective” shall be construed accordingly. Thus, toys which do not conform to the compulsory standards are liable to be held ‘defective’ under the Act, reads a ministry of consumer affairs, food and public distribution press release.

The Consumer Protection (E-commerce) Rules, 2020 stipulate that no e-commerce entity shall adopt any unfair trade practice, whether in the course of business on its platform or otherwise.
