The Ministry of Human Resource Development has finally approved the UGC issued order, originally issued by Allahabad High Court, of implementing the policy of recruiting faculty positions in the university through department-wise calculation instead of calculating the total posts for recruitment.
According to the officials in UGC, the HRD ministry has approved this decision after consulting the Law Ministry and the Department of Personnel and Training and will release an official notification for the same in the near future.
The order which was originally issued by the Allahabad High Court in April 2017, after referring to a case on teacher’s recruitment in Banaras Hindu University after which they issued an order that each department should be treated as a unit on which reservations are based.
The UGC’s Standing Committee approved this decision after examining 10 court judgments for the same and agreed of implementing the Allahabad High Court’s order to all universities.
According to the received data from past years, it was observed that there are 17,106 teaching positions at 41 UGC-funded central universities, of which 5,997 were vacant as of April 1, 2017. With the implementation of this new order issued by UGC, the representation of the reserved category people will eventually be reduced in the upcoming recruitment drives taken up by universities.
According to the new order issued by UGC, reservations will be calculated by treating each department as a unit which means that the reserved posts at any level will be represented separately for each department.
Hence a department with one vacant post, the reservation cannot be applied there since reservation cannot be implemented for a single vacant post. But, as earlier, if all posts of the professors would be clubbed together, there is a greater chance of the reserved category to be recruited for those positions.
“This (decision) will significantly reduce the number of posts (for reserved categories). Instead of doing this, the government should have approached the Supreme Court against the Allahabad High Court decision,” P S Krishnan, a former Secretary, told.
“Instead of private citizens approaching the top court, the government should have appealed against the decision. Ensuring equality is a national policy,” he added.
Good. Nation must respect the court and the rule of law. If Court orders are disrespected, than there will be chaos and anarchy in the nation and society. Good that the government and the UGC are respecting the court judgements.
Immediate clarification needed for faculty recruitment because in universities all the posts are vacant due to this students has struggled. Immediately recruitment will be finalized as early as possible by universities.
The decision for department wise post is conspiracy to make ineffective of constitutional right for reservation. It is well planned Cheos created by anti reservation people in order to maintain monopoly in higher education.
