Philips has recently filed a patent infringement case against famous mobile-maker Xiaomi in India. At Delhi High Court, Dutch consumer electronics major has asked for restraining Xiaomi from assembling, selling of phones by any of the online e-commerce platforms and retail chains in the subcontinent.

It also sought Delhi High Court to direct Central Board of Excise and Customs department at all international data points which also included airports and coastal ports across India to prevent imported Xiaomi phones from entering the country for sale purposes.

Xiaomi devices use Philips’ patented Universal Mobile Telecommunications Service (UTMS) enhancement technology like High-Speed Packet Access (HSPA), HSPA+ and LTE. So, it asked royalty for the use of its technology but Xiaomi has not responded to this till now.

After hearing Philips’ appeal, Delhi HC asked the Indian subsidiary of Xiaomi to maintain a Rs.1,000 crore bank balance on or before 2nd December.  The court order reads that the defendants will file the details of the bank accounts operated in India where amount of Rs.1,000 crores is being maintained, on or before 2nd December, 2020. Reply has to be filed within four weeks. Rejoinder has to be filed within two weeks thereafter. The next hearing will take place on 18th January, 2021.
