Synopsis: Harper Collins is been permitted to publish a book on Asaram Bapu by the Delhi High Court. The High Court, quashed the decision given on the basis of the Lower Court’s ex parte injunction.

Today, the Delhi High Court set aside the ex parte interim injunction order barring the release of a book titled ‘Gunning for the Godman: The True Story Behind the Conviction of Asaram Bapu’ (HarperCollins v. Sanchita).

In HarperCollins’ appeal against the injunction order passed by a district court in a suit preferred by the co-convict in the Asaram Bapu rape case, Sanchita, the order was given by a Single Judge Bench of Justice Najmi Waziri.

The Court ruled that, along with a flyer clarifying that the book is based on the decision of the trial court on appeal, the already printed copies of the book must be sold.

The disclaimer should be given electronically for online sales, the court added.

The Court was informed by Harper Collins that the supposedly defamatory content was based solely on the background and judgement of the trial. It was added that Sanchita, the co-accused, malafidely waited until the eve of the publication to demand a stay when the public announcement about the book launch was made in July.

In the other hand, Sanchita argued that, under Article 19(1)(a) of the Constitution, her right to a reputation and a fair hearing should be balanced by that right.

It was believed that the appeal against the verdict was still pending and that if the publishing of the book was approved, there would be a continuation of the trial and irreparable harm would be incurred.

Authored by Ajay Lamba, Additional Commissioner of Police, Jaipur and Sanjiv Mathur, the book,’ Gunning for the Godman: The True Story Behind Asaram Bapu’s Conviction,’ was scheduled to be published on September 5, 2020.

The publication of the book was postponed by the Court of Additional District Judge on the ground that the appeal against the conviction in the rape case was sub-judice before the High Court of Rajasthan.
