The Delhi High Court on Wednesday allowed the petition of Union Textile Minister Smriti Irani seeking to quash the summons filed against her by the Congress Leader Sanjay Nirupam. Court, however, dismissed a similar plea filed by Nirupam’s seeking to set aside the summons issued against him in a cross-defamation complaint filed by Smriti Irani.

High Court Justice RK Gauba who passed two separate verdicts said that the Case against Congress Leader Sanjay Nirupam will continue.

Union Textile Minister Irani in her plea requested to quash the Summons issued by the Trial Court on June 2016. Smriti Irani had also sought to quash of Complaint files by the Congress Leader Sanjay Nirupam.

While Counterpart, Nirupam had approached the Court to seek quashing of Summons issued against him by magisterial Court in March 2013. Sanjay Nirupam had also sought to quash of Complaint filed by the BJP Leader and Union Textile Minister Smriti Irani.

Congress Former MP, Nirupam had sent a defamation notice to Smriti Irani alleging her of using derogatory remarks against him after the Gujarat Assembly Elections 2012. Nirupam alleged that Smriti Irani used the foul language during a Television Debate.

Earlier, Irani filed a complaint against Nirupam for allegedly defaming her during the same debate on a private television news channel. Following which the court had framed charges against the Congress leader for using ‘derogatory and indecent language’ against the Union Textiles minister.

The court had put Nirupam on trial under Sections 500 of defamation and 509 for uttering any word or making any gesture intended to insult the modesty of a woman of the Indian Penal Code.
