No out of the blue decision has been made regarding the new Chief Justice of India. Justice Ranjan Gogoi, the senior-most judge in the Supreme court has been recommended by incumbent CJI Dipak Misra as his successor, reported Zee News.

As per tradition, before his retirement, the CJI has to recommend a name of his successor to the Central government. The line of seniority is followed in appointing the CJI.

A source told News18, “The CJI’s letter maintains the continuity… there are no surprises there as to who will be the next CJI. Convention has been followed.”

Earlier this week, Union Law Minister Ravi Shankar Prasad had sent a formal notice to CJI Misra asking for his recommendation for the next Chief Justice of India.

CJI Misra is scheduled to retire on October 2 and by the virtue of seniority Justice Gogoi will step in the former’s shoes. If the recommendation is accepted by the Law Ministry, Justice Gogoi will take oath on the same day.

There were speculations within the media whether CJI Misra will break custom by not suggesting Justice Gogoi’s name, as the latter was among the four senior Supreme Court judges who held a press conference in January this year, questioning the functioning of the apex court and the independence of the judiciary. They had also expressed dissent over the allocation of benches in the top court.

Apart from Justice Gogoi, other senior SC judges who led the press conference were Justice J Chelameswa, Justice MB Lokur, and Justice Kurien Joseph.
