Allahabad: The Allahabad High Court (HC) has reunited a 21-year-old Hindu woman with her Muslim husband and said, “has a choice to live her life on her terms”.

A bench of Justices Pankaj Naqvi and Vivek Agarwal said that since, Shikha, 21 years old woman has reached the age of majority and has herself wants to live with her husband, Salman alias Karan, “she is free to move as per her own choice without any restriction or hindrance being created by the third party,” The Indian Express report said.

The court was hearing a habeas corpus plea by Shikha, who was given over by the Etah CJM to the Child Welfare Committee (CWC) on December 7. The advisory committee had then given over her authority to her parents the following day.

As per the court, this was done “without any application of mind and against her wish. The act of CJM, Etah, and that of the CWC, Etah, reflects a lack of appreciation of legal provisions.”

It saw that the woman was a grown-up as her date of birth was October 4, 1999 and the CJM court didn’t like the way that when a school testament had been produced, at that point some other proof became “secondary in nature and should not be relied on”.

Salman alias Karan, the husband, was booked for abducting on September 27. The HC also dismissed the FIR against him.

The High Court passed the order in the wake of interacting with the woman, who presented that “she is a major, her date of birth is 04.10.1999, she has attained the age of majority and has entered into a wedlock.”

The court ordered police to give security to the couple till they arrive at their home.
