Synopsis: The Court ordered that no action should be taken against Arjun Singh, Kailash Vijayvargiya, Pawan Singh, Sourav Singh and Mukul Roy and issued a notice of plea for the transfer of the probe to the Government of West Bengal.

On Friday, five BJP leaders from West Bengal received relief from the Supreme Court against the West Bengal Police in connection with different cases which were registered against them.

A Bench of Justices Sanjay Kishan Kaul, Hrishikesh Roy and Dinesh Maheshwari ordered that no coercive action is to be taken against Arjun Singh, Kailash Vijayvargiya, Pawan Singh, Sourav Singh and Mukul Roy and also sent a notice to the government of West Bengal  that the cases should be transferred to an independent investigating agency.

At the behest of the ruling Trinamool Congress Party, the leaders approached the Supreme Court alleging witch hunting by the West Bengal Police.

The lead petitioner, Arjun Singh, who moved the Court through advocate Avantika Manohar, alleged that he was slapped with 64 cases by the Bengal police without any preliminary enquiry after he resigned from Trinamool Congress.

The plea alleges that the “purposive prosecution” carried out against Singh by the West Bengal police denied him liberty without following the due process of the law.

The Court had also been moved by a sixth petitioner, Kabir Shankar Bose, but the Bench did not issue notice on his plea. The Court instead called for a CISF report that is currently providing Bose with security.
