Synopsis: A notice was issued to the State Government by the Vacation Bench of Justices Indira Banerjee and Aniruddha Bose, but Rule 5(2)(a)(i) of the 2007 Andhra Pradesh State Judicial Service Rules was refused to be stayed.

In a petition challenging the precondition of three years of practise as an advocate to be eligible to write the Civil Judge exam in the State, the Supreme Court today sought the Andhra Pradesh (AP) government’s response.

Justices Indira Banerjee and Aniruddha Bose issued a notice to the State Government but refused to comply with Rule 5(2)(a)(i) of the Andhra Pradesh State Judicial Service Rules, 2007, which defines the above condition.

The petition filed by Regalagadda Venkatesh also sought that a notification from December 2020 inviting applications for the appointment of a civil judge (junior division) in AP be quashed.

The Court asked the petitioner during yesterday’s hearing what was the urgency of approaching the Supreme Court’s Vacation Bench. The petitioner’s counsel replied that January 2 is the last date for the filing of online applications.

However, while issuing the notice, the Court declined to pass any interim order.

The petitioner questioned a 2020 notification asking for the appointment of a junior civil judge in the AP State Judicial Services division. The question is about the requirement of 3 years of eligibility as a practising advocate. The 2007 Rules of this plea are being challenged.

The Court mentioned that there should be no urgency in the holidays to entertain this petition. On the date of reopening, let the plea be listed for hearing. Meanwhile, a notice will be issued.

The case will next be heard on 5th January 2021.
