On Tuesday, the Delhi High Court instructed the Tihar Jail authorities to provide appropriate medical care for Atul Singh Sengar, who is serving a ten-year term for his involvement in the custodial death of the rape victim of the Unnao father.

Atul Singh Sengar, the brother of expelled BJP MLA Kuldeep Singh Sengar, had approached the High Court asking for eight weeks’ parole for various health issues.

The instructions were given by a Justice Bench Vibhu Bakhru after it was informed that Atul Singh Sengar had been diagnosed with oral cancer and needed intensive care, and that the convict’s application for parole had been disposed of.

On 13th March, 2020, a trial court had convicted Kuldeep Singh Sengar, his brother Atul and five others to 10 years imprisonment in a case relating to the Unnao rape victim’s father’s custodial death. On 9th April, 2018, the rape victim’s father died in judicial custody.

On 13th July, 2018, Senger and others had been arrested by the Central Investigation Bureau (CBI), which was investigating the crime. The charges against Sengar, his brother Atul, Makhi Police Station’s in-charge Ashok Singh Bhadauria, Subinspector Kamta Prasad, Constable Amir Khan and six others in the case were then framed.

The Supreme Court had transferred the case from a court tribunal in Uttar Pradesh to Delhi High Court on 1st August, last year. While the matter was being heard through video conferencing, the counsel appearing for the Central Investigation Bureau (CBI) assessed the court that the petitioner is an influential person and is to be granted custodial parole only.

The CBI counsel said the accusation was that he and his goon had attacked the father of the prosecutor and a fake case was filed against him. They are influential people in society, who can manipulate others. He is found guilty of offences under Section 304 of IPC. He further questioned that why an appeal had not been filed and parole was being sought. Responding to the same, the convict’s counsel said that he wanted to file an appeal but could not do it because of the court’s limited functioning.

Following the arguments, the judge said that as the convict is choosing Delhi hospital for surgery, the court will give custody parole for the same.

In March this year, Tis Hazari Court of Delhi sentenced Bharatiya Janata Party (BJP) MLA, Kuldeep Singh Sengar and six others to 10 years imprisonment for the death of father of Unnao rape survivor. Sengar also serves life imprisonment for raping the minor.
