Delhi Law Minister Kailash Gehlot on Thursday sent a show-cause notice to the principal law secretary of Law Department for clearing without his approval the sanction to prosecute former Jawaharlal Nehru University (JNU) students in a case of sedition.

The sedition case related to anti-national slogans allegedly raised during a February 2016 event on the campus of JNU has been filed against former JNU Students’ Union (JNUSU) president Kanhaiya Kumar among others.

Kailash Gehlot has sought an explanation from the Law Secretary AK Mendiratta for sending the file directly to the principal home secretary stating that law secretary deliberately to bypass him.

The notice states, “It appears to have been done intentionally so that views of the Minister aren’t recorded”.

Earlier there were reports about Delhi Government seeking legal advice with regard to granting sanction for prosecution on the charge sheet in connection with JNU Sedition Case.

The Aam Aadmi Party government and the Delhi Police on Saturday levelled allegations after a court questioned the department for filing a charge sheet in the JNU sedition case against former Jawaharlal Nehru University Students’ Union (JNUSU) president Kanhaiya Kumar and nine others including Umar Khalid.

The rules allow three months time to the government for granting sanction. Delhi Police took three years to file the charge sheet. The government must be allowed due diligence and legal advice at its disposal before taking a decision,” a Delhi government source said on Tuesday. Delhi government sources further said there are rules laid down by the court for sanction of prosecution and they will be followed.

Earlier Delhi Court on Saturday asked the Delhi Police, Why did you file (the charge sheet) without approval? You don’t have a legal department”.

The Delhi Police on January 14 filed a charge sheet in connection with JNU Sedition Case 2016 against former Jawaharlal Nehru University Students’ Union (JNUSU) president Kanhaiya Kumar, Umar Khalid, and others. The accused have been booked under sections 124(A) (sedition), 323 (punishment for voluntarily causing hurt), 465 (punishment for forgery), 471 (using as genuine a forged document or electronic record), 143 (punishment for being a member of an unlawful assembly), 149 (being a member of an unlawful assembly), 147 (punishment for rioting) and 120B (criminal conspiracy) of the Indian Penal Code (IPC) as reported by many news agencies.

However, Both – Kanhaiya Kumar and Umar Khalid – termed the charge sheet as Politically Motivated and raise a question on the timing of the charge sheet. While Kanhaiya Kumar thanked PM Modi while Umar Khalid said we’re ready to face trial but are you ready to face JPC on Rafale?
