The split in the grand alliance between JD(U)RJD and Congress and then JD(U)-BJP alliance in the Bihar had put the public as well as political pundits in surprise. Nitish Kumar got the BJP’s support only after a few hours of resigning from the Chief Minister’s post and the next day he again took the oath of office as chief minister.

Nitish Kumar faced criticism for forming a government with the BJP and breaking from the alliance. RJD leaders took Nitish Kumar on the back and also accused of being dishonest, cheater and breaking the trust of the people.

Patna High Court had accepted two petitions challenging the formation of a new government by Nitish Kumar’s JD(U) along with the BJP.

One petition was filed by Jitender Kumar and the second by Rashtriya Janata Dal legislators Saroj Yadav and Chandan Kumar Verma. Both of them had expressed surprise over the Bihar Governor’s decision that RJD was the largest party in the Bihar Legislative Assembly and according to the rules, RJD should have had the chance to form the government first. The petitions said that as this was against the Constitution, the court should intervene and dismiss the newly formed Nitish Kumar government formed with the BJP’s support.

After the hearing held for the 2 petitions on Monday, Patna High Court dismissed the PILs saying that the court’s intervention was not required after the CM cleared the floor test. After hearing all parties, a division bench comprising Chief Justice Rajendra Menon and Justice A K Upadhyay dismissed the two PILs saying no intervention of the court is required, after floor test in the state Assembly.
