The Union Cabinet on June 12 approved a fresh bill to ban the instant triple talaq. Earlier, the  Triple Talaq Bill was passed by Lok Sabha in December last year amid opposition uproar with 245 MPs voted were in favor of the bill, 11 voted against it. However, it got stuck in the upper House, Rajya Sabha, as the government has no majority there.

The Bill passed by the previous government in Lok Sabha was lapsed after the dissolution of 16th Lok Sabha.

According to the Rajya Sabha Legislative Procedure, a Bill pending in the Upper House which has not been passed by Lok Sabha does not lapse on the dissolution of the Lower House. But a Bill passed by Lower House (Lok Sabha) and is pending at Rajya Sabha stands Lapsed on the dissolution of Lok Sabha.

Later, the Union Cabinet passed an ordinance on Triple Talaq that has the validity of 6 months. Now, the new government plans to convert 10 ordinances into law. All those ordinances were approved by the Union Cabinet in February-March this year by the previous government.

The new Bill will deem the practice ‘illegal’, with the husband supposedly facing a prison sentence of three years. The BJP led government had many amendments to the original Bill after it faced a lot of criticism from opposition parties. It should be noted that the earlier bill doesn’t have the provision of Bail.

Among the most controversial bills that lapsed were Citizenship Amendment Bill 2016, Triple Talaq Bill, Adhaar and Other Laws (Amendment) Bill, 2019 that was cleared by Lok Sabha but got stuck in the upper House of the Parliament.

The new government will give a push to all such bills in the coming days.
