The Meghalaya High Court urged the India’s Prime Minister Narendra Modi and other minister to consider citizenship to all Hindus, Jains, Sikhs, Garos, Buddhists, Parsis, Khasis, Jaintias, Christians who came from the countries like Bangladesh, Afghanistan and Pakistan, without raising and pointing any questions over their religion.

Justice SR Sen has on Monday, while disposing a filed petition of Amon Rana, gave 37-page judgement to the centre and its copy was then available on Tuesday. The judgement has observed that these immigrants are being tortured yet and they does not have any place to live.

Sen, in a judgement, said, “I make it clear that nobody should try to make India as another Islamic country, otherwise it will be a dooms day for India and the world. I am confident that only this Government under Shri. Narendra Modiji will understand the gravity, and will do the needful as requested above and our (West Bengal) chief minister Mamata Banerjee will support the national interest in all respect.”

Sen has on Monday, observed and said India should had declared itself as a Hindu nation at the very first time of partition. Sen said, “Pakistan declared themselves as an Islamic country and India, since (it) was divided on the basis of religion, should have also been declared as a Hindu country, but it remained as a secular country.”

Sen said, “I can simply say that the Hindus, Sikhs, Jains, Buddhists, Parsis, Christians, Khasis, Jaintias and Garos residing in India, on whichever date they have come to India, are to be declared as Indian citizens and those who will come in future also to be considered as Indian citizens.”

Sen further said, “I request our beloved prime minister, home minister, law minister and Members of Parliament to bring a law to allow the Hindus, Sikhs, Jains, Buddhists, Parsis, Christians, Khasis, Jaintias and Garos who have come from Pakistan, Bangladesh and Afghanistan to live in this country peacefully and with full dignity without making any cut off year and be given citizenship without any question or production of any 21 documents.”

The judge said that these communities should not be questioned and allowed to settle in India at any time and the government may hand over rehabilitation “proper” to them and should be declares as the citizen of India. Same case for Indian, who are residing in foreign, could come India ant time and will be tagged as Indian citizens.

Sen said, “They may be allowed to come at any point of time to settle in India and government may provide rehabilitation properly and declare them citizens of India. Similar principle to be adopted for those Hindus and Sikhs who are of Indian origin and presently residing abroad to come to India at any time as they like and they may be considered automatically as Indian citizens.”

Sen said, “A burning example is that if we visit the border, it is difficult to understand which land falls within India (in Meghalaya) and which is in Bangladesh as somebody’s kitchen is in India and their bedroom is in Bangladesh.”

While requesting for “uniform law” to government, that should bind all citizens, Sen said, “Anybody opposing the Indian laws and constitution, they cannot be considered as citizens of the country. We must remember that first, we are Indians, then good human beings and thereafter comes the community we belong to.”

The order stated: “India achieved independence through bloodshed and the worst sufferers were the Hindus and Sikhs who had to leave their forefather’s property, birthplace with tear and fear and we will never forget that.”

A 37-page order by Sen to centre stated: “As we all know, India was one of the largest country in the world and there was no concept of Pakistan, Bangladesh and Afghanistan. They were in one country and was commanded by Hindu kingdom but thereafter the Mughals came to India and captured the different parts of India and started ruling the country and at that point of time many conversion took place by force.”
