An apex court of Japan’s Tokyo granted bail to the former Nissan motor representative director Greg Kelly on Tuesday, while ousted Nissan chairman Carlos Ghosn still remains in custody.

According to news reports, in an official statement, the Tokyo district court said the bail of Kelly was set at $635,612 (70 million yen). The court later cleared that Kelly did the payment through cash.

On November 19, Kelly with his former boss was detained over the suspicion of understating Carlos Ghosn’s financial statement (income) in the statement, that too for several years. Since then, neither Kelly nor Ghosn have been able to defend themselves in front of the public, so now it is expected that Kelly’s bail could now provide him the very first opportunity to defend both of themselves.

Both arrest has shocked the global car market and industry and also strained Nissan’s ally with the French car maker – Renault SA. Reports has said the court’s decision meant that Kelly could be released early Tuesday.

Court said prosecutors has appealed the decision. Prosecutors denied to comment over the release of Kelly. Tokyo’s court had extended Ghosn’s detention for more 10 days.

A Nissan spokesperson said, “The Company’s own investigation uncovered substantial and convincing evidence of misconduct, resulting in a unanimous board vote to dismiss Ghosn and Kelly as chairman and representative director. Our investigation is ongoing.”
