Synopsis: The present case had been filed as a habeas corpus petition in August 2019, by the woman’s uncle before the Gujarat High Court.

The Gujarat High Court has directed the Unique Identification Authority of India (UIDAI) to validate the same person’s two Aadhaar cards and to request a reply on which of the cards is authentic.

The high court has sought UIDAI’s report to determine a woman’s age, who appeared to be an adult, but according to her uncle she was still a minor when she eloped last year with her boyfriend. Since the police station in Vivekanandnagar has booked the guy for the abduction of a minor, the court feels that confirming the woman’s actual birth date would bring an end to the FIR itself.

This occurred when the woman furnished an Aadhaar card pretending to be an adult with the record representing her birth in 1999, but she was seen as being born in 2002 on the Aadhaar card furnished by her uncle.

In this case, in August 2019, the woman’s uncle had filed a habeas corpus petition alleging she was a minor and was abducted in June 2019 by a man from Muzaffarnagar in Uttar Pradesh from his lawful custody. Parents and siblings of the woman are living in Bihar and she lived in Ahmedabad with her paternal uncle.

She was identified and taken to Ahmedabad a year back, and last week presented before the court. She flatly declined to see her uncle, and argued that she had left home because her uncle tried to marry her, so she ran away and got married with a man of her choice. She insisted on her husband joining in.

The woman was sent to the Paldi Vikas Gruh, since her date of birth was ambiguous. The Anti-Human Trafficking Cell, Ahmedabad is investigating the case because the suspicions were that the minor girl had been kidnapped and may have been forced into prostitution.

The cell forwarded both the Aadhaar cards to UIDAI for authentication, but the state government submitted to 
the HC that UIDAI would need its permission to validate the cards and return to the court. 

The high court has posted further hearing on September 2.
