The Indian National Congress has alleged that Amit Shah’s poll affidavit consists of ‘irregularities’. The Congress has stated that it would approach the EC and request them to cancel his membership to the Rajya Sabha till all his liabilities are declared. The allegation arose when Amit Shah didn’t declare his possession in the poll affidavit despite two plots of land owned by him being mortgaged by his son Jay Shah for obtaining credit facility charges. However, these charges were strongly dismissed by the ruling party as “bogus and fake”.

Jairam Ramesh said that Shah’s son Jay Shah’s company, Kusum Finserve LLP, was given credit facilities of Rs 97.35 crore by two cooperative banks and one government undertaking. “He mortgaged properties registered in his father’s name. But Shah didn’t mention this in his affidavit.”

Ramesh defended his argument by stating that, “ he (Jay) availed a credit limit of Rs 95 crore from various banks…. I don’t think there can be any other such example where an entity with Rs 6 crore net worth has been given a credit limit of Rs 95 crore.” Further explaining, “availed loans from various banks, and while taking these loans mortgaged two plots of land and a commercial building in Ahmedabad. The owner of this land is not Jay Shah, but Amit Shah…. He owns two plots of land, against which his son took loans from banks, and Amit Shah declares he has no liability,”

BJP spokesperson, Sambit Patra defended by saying “The allegations against him (Shah) are totally bogus and fake…. Even if Amit Shah has mortgaged his property, it does not mean that liability is his.”

Patra said Shah cannot show a liability of an independent entity belonging to his son as his own liability. Besides their own liabilities, politicians have to show the liabilities of their spouse and dependents or minor children. “He (Shah) will be violating the law if he shows his adult son’s liability in his election affidavit,” he added.
