Synopsis: The ad-interim protection given to Ranaut was extended to give her time for a period of 6 weeks to approach the High Court.

On Tuesday, the Bombay City Civil Court in Dindoshi dismissed a notice of motion filed by actress Kangana Ranaut in a suit challenging a notice issued by the Brihanmumbai Municipal Corporation (BMC) in connection with Ranaut’s alleged unauthorised work at her residential building in Khar, Mumbai.

However, the ad-interim protection given to Ranaut was extended by Additional Sessions Judge LS Chavan in order to challenge the dismissal order in the Bombay High Court.

The judge of the session had earlier restricted the BMC officials from taking any coercive action against the property of Ranaut in anticipation of the notice until the court ruled on her application.

BMC wanted to notify Ranaut, through its notice, that she had carried out unauthorised work beyond the approved plan without receiving the necessary permission from the Corporation.

In her application, Ranaut argued that the notice issued by BMC was vague and did not specify the precise nature of the alleged unauthorised construction.

She further argued that after the notice, the speaking order given against her was also not in accordance with the law.

Last month, after the BMC officials had demolished part of the property located at Bandra, Mumbai for alleged unauthorised works, the Bombay High Court granted Ranaut relief.

The High Court revoked the notice of demolition issued by BMC and added that Ranaut could take initiatives to ensure her property habitable and to regularise it.

The appointment of a valuer was also directed by the Court to determine the compensation payable to Ranaut for the demolition of her property.
