The washed out opposition is trying to turn the tables on Bihar Chief Minister not leaving any chance to pull him down. Just like RJD chief Lalu Prasad Yadav‘s son and former Deputy Chief Minister Tejashwi Yadav was asked to resign on the grounds of him being atached to a CBI case, a plea is files against Nitish also, allegedly concealing a pending criminal case against him.

BJP and Nitish had asked Tejashwi Yadav to resign from the post saying that he was attached to a CBI case. Few members of Yadav’s family along with Tejashwi were charged by the CBI, regarding the irregularities in sanctioning the tender for maintenance of hotels. The FIR lists irregularities in the tender for development, maintenance and operation of BNR Hotels in Ranchi and Puri, sanctioned to the private Sujata Hotels in 2006.

The demand for resignation also added fuel to the already prevailing problems between the Coalition of JD(U) and RJD ultimately resulting in the breakup. It seems like after Nitish formed the new government in coalition with BJP, it seems like the opposition wants to walk on the path paved by Nitish.

On Monday a plea was filed by advocate ML Sharma against Nitish Kumar seeking cancellation his membership of the state Legislative Council for allegedly concealing a pending criminal case against him. The plea alleged that there was a criminal case against the JD(U) leader wherein he was accused of killing a local Congress leader Sitaram Singh and injuring four others ahead of Lok Sabha by-election to the Barh constituency in 1991.

The lawyer representing the petitioner said that under Election Commission’s 2002 order it is mandatory for candidates to disclose criminal cases against them in their affidavits attached to nomination papers but Nitish did not do so. Election commission in spite of knowing facts of his criminal cases did not cancel his membership of the house. Hence the petitioner sought the cancellation of Kumar’s membership of the House.

A bench of Justices Justice Dipak Misra, Amitava Roy and A M Khanwilkar said it will look into the matter after petitioner sought for an urgent hearing for the plea.
