Supreme Court of India, on Wednesday, rejected last month’s order of Rajasthan High Court and stated that the court can not stop legislative decisions. The hearing was on a plea filed by Rajasthan government last month after high court had put a stay on Rajasthan Government’s order of increasing the reservation for other backward castes.

After the Rajasthan government order, the total percentage of reservation had reached 54%. However, according to the constitutional laws, the reservation in state or central schemes cannot go over 49%. After the high court had put a stay on the order, Rajasthan government had challenged the decision in Supreme Court.

The Supreme Court, however, added that the total reservation can not cross 50% and if there is a need, the writ petition will be decided by the high court.

Rajasthan Government had decided to increase the reservation for OBCs to 26% from the existing 21%, which had led to an opposition by a lot of other groups, including the high court.

The state government has been asked to redraft the reservation bill in the next session. We will get more details on this soon and will keep this page updated. Stay tuned.
