The Top Court on Wednesday deferred the hearing of the plea filed by DMK seeking disqualification of Tamil Nadu Deputy Chief Minister O Panneerselvam and 10 other AIADMK for voting against the confidence motion initiated by the State Chief Minister Edapadi K Palaniswamy way back in February 2017.
Months after, the Apex Court on Tuesday agreed to hear the petition filed by MK Stalin’s DMK seeking disqualification.

In the petition filed by DMK, it has been stated that Deputy Chief Minister O Panneerselvam and other 10 AIADMK MLAs’, who was then a part of a rebel group, voted against the motion or a whip. The DMK in the plea alleged that going against the whip is amount to ‘Disqualification on Grounds of Defection rules, 1986’.
Earlier in September 2017, DMK had approached the Madras High Court with the same plea. However, the court refused to hear the plea and dismissed it.
Later, the DMK had also made a petition before the Assembly Speaker seeking disqualification of all MLAs under Paragraph 2 (1)(b) of the Tenth Schedule of the Constitution.
However, the Assembly Speaker did not issue any notice on the disqualification petition.
In Tamil Nadu Assembly, the AIADMK has currently 123 MLAs including the speaker. While MK Stalin‘s DMK has 100 MLAs, its allies – Congress and IUML- have seven and one seats respectively in the 234-member House.
