Anil Ambani led Reliance Communication (RCom) writes a letter to the Department of Telecommunication (DoT) to get a no objection certificate (NOC) for the spectrum sale between RCom and Mukesh Ambani led Reliance Jio.

The letter cited the recent order by the Telecom Dispute Settlement & Appellate Tribunal (TDSAT) which took the decision that liabilities of the past lies with the seller not with the new buyer. In this deal RCom is selling its spectrum to Reliance Jio.

The tribunal further ordered the DoT for approval to RCom’s pact of selling spectrum to Reliance Jio and adding that buyer (Reliance Jio) cannot be held liable until the airwaves trading deal is concluded.

In the event, if DoT does not clear RCom’s spectrum business pact with Jio, the Anil Ambani-led telcom might moves to Supreme Court soon as “it’s armed with a favourable telecom tribunal order,” a person familiar with the matter said.

The DoT has so far made its stand clear that Mukesh Ambani led Reliance Jio cant be held liable for the past dues of RCom. This forced the RCom to go to the tribunal for the interpretation of spectrum related laws. This is the major bone of contention between RCom, Reliance Jio and DoT  as RCom has spectrum dues 2,947 crore of and is not allowing the long time pending spectrum deal to conclude.
