Putting matters to ease, Delhi High Court quashed a petition which sought to fix the minimum qualification and maximum age needed for fighting the elections. The Court dismissed the petition on Wednesday.

The bench that set aside the petition was led by Chief Justice DN Patel. The petition filed by advocate Ashwini Kumar Upadhyay. Ashwini Kumar Upadhyay also requested the court to issue a direction to the Election Commission for the same. However, the petition was put aside.

The bench observed that it is not within the court’s limit and the matter lies within the discretion of the parliament. As quoted by ANI, while dismissing the petition, the court said, “Graduation is not a yardstick of wisdom. It all depends upon the vibrancy of a person and his enthusiastic approach towards the work.

The bench also said that it is not okay to put the conditionality of age limit on the election contesting right as “some persons are younger at an advanced age and some are older at a young age.

Interestingly, at present, our Indian political set-up doesn’t provide for any such minimum educational qualification to contest elections in the country. Neither any legislation or constitutional provision in this regard exists in our nation.
